Please read these terms carefully before using 2nd Life South Africa.

1. Acceptance of Terms
By accessing or using the 2nd Life South Africa platform (“Platform”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree, you must not use the Platform.
These Terms constitute a legally binding agreement between you and 2nd Life South Africa (Pty) Ltd (“we”, “us”, “our”).
2. Platform Description
2nd Life South Africa is a free online marketplace that facilitates connections between:
- Construction companies and contractors offering excess or problematic materials
- Individuals, artists, makers, and DIY enthusiasts seeking materials for creative reuse
We provide only a facilitation platform. We do not own, sell, transport, inspect, verify, or guarantee any materials listed.
3. User Roles
The Platform supports two primary user roles:
- Material Providers: Users offering materials
- Material Collectors: Users seeking to collect materials
Users may act in one or both roles.
4. User Responsibilities
4.1 Material Providers
Material Providers agree to:
- Provide accurate and truthful descriptions
- Clearly disclose known defects, damage, hazards, or restrictions
- Ensure materials are available as stated
- Respond to enquiries within a reasonable timeframe
- Comply with applicable waste, environmental, and safety regulations
- Not list hazardous or regulated materials without lawful disclosure
4.2 Material Collectors
Material Collectors agree to:
- Collect materials at the agreed time and location
- Take full responsibility for transport, handling, and use
- Inspect materials prior to collection
- Use materials safely and responsibly
- Communicate clearly and respectfully
5. Prohibited Conduct
Users may not:
- List materials they do not have the right to give away
- Provide false or misleading information
- Use the Platform for commercial sales
- Harass, abuse, or harm others
- List stolen or illegal materials
- List asbestos, radioactive substances, or other regulated hazardous materials without lawful disclosure
- Violate applicable laws or interfere with Platform operations
6. Disclaimers and Safety
6.1 No Warranty
All materials are provided “as is” and “as available”. We make no warranties regarding:
- Condition, quality, legality, or safety
- Accuracy or completeness of listings
- Suitability for any purpose
6.2 Safety Notice
Some materials may contain hazardous substances. Users are solely responsible for:
- Assessing material safety
- Using appropriate protective equipment
- Seeking professional advice where uncertainty exists
7. Limitation of Liability
To the maximum extent permitted by South African law:
- We are not liable for any direct, indirect, incidental, or consequential loss
- We are not responsible for disputes between users
- We are not liable for injury, damage, or loss arising from material collection, handling, or use
Our total liability shall not exceed the fees paid to use the Platform (R0).
8. Intellectual Property
All Platform content, design, branding, and software are owned by or licensed to us and protected by applicable laws.
By posting content, users grant us a non-exclusive, troyalty-free license to use and display that content solely to operate the Platform.
9. Termination
We may suspend or terminate access at any time, without notice, if we reasonably believe these Terms are violated or harm may occur.
Users may stop using the Platform at any time. Listings may remain visible unless removal is requested.
10. Changes to These Terms
We may update these Terms from time to time. Continued use of the Platform after updates constitutes acceptance of the revised Terms.
11. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of South Africa, and all disputes are subject to the exclusive jurisdiction of South African courts.
